Terms of Service

1. Acceptance of Terms

By creating an account on the EggieNet Platform, operated by Tangible Robots Inc. (doing business as "EggieNet"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

2. Age Requirements

You must be at least 18 years of age to create an account and participate in data collection activities on the EggieNet Platform. By creating an account, you represent and warrant that you are at least 18 years old.

We do not knowingly collect personal information from persons under 18. If we learn that a person under 18 has created an account, we will promptly delete that account and all associated data. If you believe a person under 18 has created an account, contact [email protected].

3. Description of Service

EggieNet is a data collection management platform used to coordinate, upload, annotate, and manage egocentric video footage captured from wearable and action cameras (including DJI, GoPro, and similar devices) for the purpose of training artificial intelligence models.

4. Data Collection Participation

This includes the right to:

• Use footage to train artificial intelligence and machine learning models
• Anonymize and process footage into AI training datasets
• Sell and license anonymized, processed datasets to third parties
• Create derivative works from the footage for AI research purposes

5. Privacy Protections Commitment

EggieNet commits to the following privacy protections before any data is shared or sold:

• All audio will be muted or permanently deleted
• All faces will be blurred
• All phone and screen content will be blurred
• All visible names on items, clothing, signs, and documents will be blurred
• All license plates will be blurred

6. User Responsibilities

• You must only upload footage that you have the legal right to share
• You must inform any identifiable individuals appearing in footage that they may be recorded
• You must not upload footage recorded in locations where recording is prohibited by law
• You are responsible for maintaining the security of your account credentials
• You must not attempt to reverse-engineer, scrape, or misuse the platform

7. Intellectual Property

You retain ownership of the raw video footage you upload. By uploading, you grant EggieNet the license described in Section 4. Anonymized, processed datasets created by EggieNet from your footage are the intellectual property of EggieNet.

8. Account Termination

You may delete your account at any time from your account settings. EggieNet may terminate accounts that violate these Terms. Termination removes your personal account data but does not retroactively remove anonymized footage already included in processed datasets.

9. Disclaimers & Limitation of Liability

The EggieNet platform is provided "as is." EggieNet makes no warranties regarding uptime or data availability. To the maximum extent permitted by law, EggieNet is not liable for indirect, incidental, or consequential damages arising from use of the platform.

10. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Disputes shall be resolved in the courts of California.

Local Mandatory Laws: Notwithstanding the foregoing, if you reside in Mexico, Colombia, or another jurisdiction where mandatory local consumer protection or data protection laws apply, nothing in these Terms limits your rights under those laws. In particular:

• Mexico: Your rights under the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP) and the Ley Federal de Protección al Consumidor are preserved in full.
• Colombia: Your rights under the Ley 1581 de 2012 (Habeas Data), the Estatuto del Consumidor (Ley 1480 de 2011), and applicable regulations of the Superintendencia de Industria y Comercio (SIC) are preserved in full.
• United States: Your rights under state consumer privacy laws (including CCPA/CPRA, VCDPA, CPA, and others) are preserved in full.

11. Changes to Terms

We may update these Terms. Material changes will be communicated by email and by a notice on the platform. Continued use after the effective date constitutes acceptance.

12. Analytics Data Collection

This data is collected to improve platform security, monitor for unauthorized access, analyze usage patterns, and generate aggregated analytics reports that are visible to platform administrators. Individual session data is retained for security auditing purposes. Aggregated, anonymized analytics data may be retained indefinitely.

We do not use this data for advertising, marketing, or any purpose other than platform improvement and security. This data is never sold to third parties.

13. SMS Two-Factor Authentication

By opting in to SMS 2FA, you acknowledge and agree that:

• SMS messages are sent solely for account security verification — specifically, one-time 6-digit codes when you sign in
• SMS messages are delivered through Firebase (Google), a third-party communications provider, and your phone number is shared with Firebase only for this purpose
• No marketing, promotional, or advertising messages will ever be sent to your phone number
• Message frequency is limited to login events and is typically 1–3 messages per login session
• Standard message and data rates from your mobile carrier may apply
• You may opt out at any time by disabling SMS 2FA in your profile settings, which will permanently delete your phone number from our system
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties

14. Dispute Resolution

Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in the State of California. Each party shall bear its own costs. You agree to waive any right to a jury trial or to participate in a class action.

For residents of Mexico and Colombia: The arbitration clause and class action waiver above apply only to the extent permitted by your local law. If mandatory local law provides you with the right to bring claims before local courts or consumer protection agencies (including PROFECO in Mexico or the SIC in Colombia), those rights are preserved and this arbitration clause does not limit them.
